These Terms & Conditions (“Terms”) govern your access to and use of PixelPlot AI, including the website, application, tools, and services (collectively, the “Service”). Our payment infrastructure is powered by Stripe. Depending on your jurisdiction and local billing regulations, payments are processed either directly by AI CREATIVE LABS SRL via Stripe, or through Stripe acting as our Merchant of Record.
By accessing or using PixelPlot AI, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & Age Verification
You must be at least 18 years old to use PixelPlot. By creating an account and accessing the platform, you must pass our age verification gate to confirm you are an adult. You agree to provide accurate information and maintain the security of your credentials. You are responsible for all activity under your account.
2. What PixelPlot Provides
PixelPlot is an AI-assisted creative platform for generating ad concepts, videos, scripts, and visual assets. PixelPlot provides drafts and creative assistance, not guaranteed outcomes. You remain responsible for reviewing and approving all outputs.
3. AI-Generated Content Disclaimer
AI outputs may contain errors or inaccuracies. PixelPlot does not guarantee performance, results, or compliance with third-party platform policies (e.g., Meta, TikTok). You are solely responsible for validating all outputs before use.
4. Ownership & Intellectual Property
- 4.1 Your Content: You retain ownership of your brand inputs, product data, prompts, and final generated assets.
- 4.2 License to Operate: You grant us a limited license to process your inputs solely to operate and improve the Service.
- 4.3 PixelPlot IP: All software, UI, and proprietary systems remain the exclusive property of AI CREATIVE LABS SRL.
5. Subscriptions, Payments & Refunds
Our billing is managed via Stripe. By purchasing a plan or credits, you agree to the following:
- 5.1. General Refund Policy: Unless required by applicable law, all transactions are non-refundable and non-exchangeable.
- 5.2. AI Credit Consumption: Because PixelPlot AI incurs immediate, non-recoverable compute costs from our GPU and upstream providers for every generation, used credits are strictly non-refundable.
- 5.3. Right of Withdrawal (EU/UK Users): By clicking “Generate” or using any AI feature, you provide express consent to begin the digital service immediately. You acknowledge that this results in the loss of your 14-day statutory right of withdrawal for the portion of the service (credits) already consumed.
- 5.4. Unused Balance: Refunds for fully unused credit packs or subscriptions may be requested within 14 days of purchase, provided the credit balance remains at 100%.
- 5.5. Discretionary Refunds: Discretionary refunds will not be issued where there is evidence of fraud or refund abuse.
6. Prohibited Content, Acceptable Use & Content Controls
6.1 Absolute Prohibitions: You are strictly prohibited from using the Service to create, generate, upload, distribute, or facilitate any content that includes:
- Child Sexual Abuse Material (CSAM) or Child Sexual Exploitation and Abuse (CSAE).
- Adult, pornographic, or explicitly sexual content (including non-consensual explicit imagery/Deepfakes).
- Racist content, hate speech, harassment, or material promoting violence and systemic discrimination based on race, ethnicity, religion, gender, disability, or sexual orientation.
- General non-compliant material, including but not limited to malware generation, dangerous physical activities, cyberattacks, or illegal endeavors.
This restriction is absolute, non-negotiable, and monitored across all modalities (text, image, and video).
6.2 Technical Safeguards & Two-Layer Enforcement: PixelPlot employs a strict, multi-tiered compliance infrastructure to actively block prohibited content:
- Layer 1 (Prompt Enforcement): No user prompt is transmitted directly to generative models. Every user request is securely intercepted at the server level and systematically combined with mandatory system instructions and strict negative prompts designed to neutralize non-compliant topics before processing.
- Layer 2 (Model-Level Guardrails): PixelPlot routes requests through partner foundation models. All generation requests are subject to the native, institutional safety thresholds of these providers, which automatically suppress, error out, or block any content violating public safety or explicit material regulations.
6.3 Platform Integrity & Violations: You may not use PixelPlot to violate laws, infringe intellectual property, or engage in automated scraping, account sharing, or systematic abuse of the infrastructure. Any attempt to bypass, reverse-engineer, or jailbreak our technical safeguards will result in immediate account deactivation, a permanent ban from the platform, and legal reporting to law enforcement authorities or organizations like the NCMEC where required. We reserve the right to suspend or terminate accounts immediately upon any violation.
7. Cancellations & Termination
You may cancel your subscription at any time via your account settings dashboard. Cancellation prevents future billing cycles but does not trigger a refund for the current billing period.
8. Limitation of Liability
To the maximum extent permitted by law, PixelPlot is provided “as is.” AI CREATIVE LABS SRL shall not be liable for indirect or consequential damages. Our total liability shall not exceed the amount paid by you in the previous 12 months.
9. Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any disputes shall be settled in the competent courts of Bucharest.
